TERMS of SERVICE
The following terms and conditions of service are applicable to all services and computer repair provided by Cyber Tourniquet. Terms and conditions may change at any time, with or without notice. It is the responsibility of customer or prospective customer to read the terms of service before contacting Cyber Tourniquet to inquire, purchase or schedule a service engagement. By engaging Cyber Tourniquet for services, you are indicating your agreement to be bound by all of the terms and conditions outlined within this document.
Appointment:
• Its Customer's responsibility to show up on time at the scheduled time and to inform Cyber Tourniquet for cancellation or delay of any of the service a minimum of two (2) hours prior to an appointment to cancel or reschedule an appointment.
• Cyber Tourniquet will call the Customer(s) 1 hour to ahead from the appointment. If Cyber Tourniquet didn't get the answer, appointment will be automatically cancelled.
Diagnostic Fee:
• A diagnostic fee may be assessed for items that are either non-repairable or if the service or repair is declined for any reason.
• If the Customer(s) chooses to use Cyber Tourniquet's service or to repair the computer, the diagnostic fee is waived.
Warranty:
• Cyber Tourniquet provides 30 days warranty on its service(s) starting from the day when the service is completed.
• Warranty only covers identical issues which were originally performed.
• Cyber Tourniquet does not warrant any damage or system problems that arise from software corruption, unauthorized modification, user error or abuse of the equipment.
• Computer systems, hardware components, peripheral devices, software and any other tangible component are warranted only by the manufacturer or publisher of such component and are limited to the terms set forth by said manufacturer or publisher.
• Services rendered by Cyber Tourniquet may void manufacturer warranties. Cyber Tourniquet does not assume any liability in the event that the manufacturer warranties are voided.
• Whole unit replacement or refund (wholly or partially) is not an option to Cyber Tourniquet's warranty agreement.
Abandoned Goods:
• Any item(s) left at our place for more than 30 days considered abandoned.
Deposit, Fees and Payment:
• Deposit may be required for service(s), including but not limited to: onsite service; pick up and delivery; custom build PC; hardware, software, or any other purchase required for the service or requested. Deposit must be paid prior to the service.
• Customer(s) agree to pay all applicable charges and fees related to the applicable service as well as any taxes or other charges due including no-show fees, trip charges, set-up fees or termination fees.
• All the fees, charges, and money owed to Cyber Tourniquet must be paid in full upon completion of services.
• Unless stated in writing otherwise, all fees and charges are nonrefundable.
• Cyber Tourniquet owns the right to withhold, cancels, or suspend its service for any unpaid fees and charges.
Customer's Responsibility to Back-Up Data:
• It is Customer's responsibility to back-up the data, software, information or other files stored on Customer's computer, hard drive, and/or any other data storage media.
• Neither Cyber Tourniquet nor its third party service provider shall be liable under any circumstances for any loss, disclosure, alteration or corruption of any data, software, information, files, or other media.
Safe Access to Equipment:
Customer(s) agrees that they will provide full access to computer systems, systems, peripherals or software that needed to service and that power, network connectivity and a safe climate controlled work environment is provided along with full cooperation and access to enter Customer(s) home or business to perform services. If a Cyber Tourniquet representative arrives at the schedule service time and he or she does not reasonably have access, cooperation, or safe working areas, then service may be denied and a cancellation fee will be charged.
Software / Hardware Licensing & Warranties:
Customer(s) agree that they will be responsible for all software licensing installed on their computer. Cyber Tourniquet provides technical support and consulting for third party software and/or equipment. Cyber Tourniquet make no warranty that Cyber Tourniquet is an authorized service provider for Third Party Software or for any equipment; it is Customer's sole responsibility to determine if they require additional rights for Cyber Tourniquet to provide such support, and if so, to acquire such rights. Customer(s) acknowledge that support of Third Party Software or equipment by an unauthorized service provider may void any warranty made by the supplier of such Third Party Software or equipment.
Termination of Service:
• Customer(s) agree to inform Cyber Tourniquet for cancellation or delay of any of the service a minimum of two (2) hours prior to an appointment to cancel or reschedule and appointment. Otherwise, at Cyber Tourniquet's sole discretion, a missed or late appointment fee may apply.
• Cyber Tourniquet owns the right to refrain and/or terminate its service, with or without any reason at any time.
In no event shall Cyber Tourniquet (or its officers, employees, parent, subsidiaries, or affiliates), its third party licensors, providers or suppliers, including gsps, be liable for:
• (A) Any failure or delay in performance due to any cause beyond its control.
• (B) Loss of Customer's data or if changes in operation procedures or service require modification or alteration of the Customer's equipment render the same obsolete or otherwise affect its performance.
• (C) Direct or indirect liability associated to copyright infringement and/or stolen materials supplied by the Customer(s).
• (D) Any direct, indirect, special, consequential or incidental damages, including without limitation, lost profits or loss of revenue or damage to data arising out of the use, partial use or inability to use the service, regardless of the type of claim or the nature of the cause of action, including without limitation, those arising under contract, tort, negligence or strict liability, even if Cyber Tourniquet has been advised of the possibility of such claim or damages, or any claims against the Customer(s) by any other party.
INDEMNIFICATION
Customer(s) agree to defend, indemnify and hold harmless Cyber Tourniquet from and against all liabilities, costs and expenses, including reasonable attorney's fees, related to or arising from:
• (A) any violation of applicable laws, regulations or this Agreement by the Customer(s) (or any parties who use Customer's account, with or without permission, to access the Service);
• (B) the use of the Service or the Internet or the placement or transmission of any message, information, software or other materials on the Internet by the Customer(s) (or any parties who use Customer's account, with or without permission, to access the Service);
• (C) negligent acts, errors, or omissions by the Customer(s) (or any parties who use Customer's account, with or without permission, to access the Service);
• (D) injuries to or death of any person and for damages to or loss of any property, which may in any way arise out of or result from or in connection with this Agreement, except to the extent that such liabilities arise from the active negligence or willful misconduct of the other party; or
• (E) claims for infringement of any intellectual property rights arising from the use of the Service, Software, or the Internet.
Review / Testimonial Authorization and Release Information
Customer(s) understand the review and testimonial made on behalf of Cyber Tourniquet may be used in connection with publicizing and promoting Cyber Tourniquet. Customer(s) authorize Cyber Tourniquet to use their name, brief biographical information, and the review or testimonial as defined by the Customer(s).
Customer(s) authorize Cyber Tourniquet to copy, exhibit, publish or distribute the review or testimonial for purposes of publicizing Cyber Tourniquet's programs or for any other lawful purpose. These statements may be used in printed publications, multimedia presentations, on websites or in any other distribution media. Customer(s) agree that they will make no monetary or other claim against Cyber Tourniquet for the use of the statement.
In addition, the Customer(s) waive any right to inspect or approve the finished product, including written copy, wherein their likeness or their review or testimonial appears.
I hereby hold harmless and release Cyber Tourniquet from all claims, demands and causes of action which I, my heirs, representatives, executors, administrators or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
Privacy policy:
• As part of the service, Cyber Tourniquet may collect Customer's personal information such as contact information; including name, mailing address, phone number and e-mail address.
• Any personal information collected by Cyber Tourniquet may be used to send information, respond to inquiries, and/or other requests or questions and will not be shared or exposed to any other individual or Third Party Company unless it is required for the service.
